Thank you for visiting Gather6 Corp.’s beta release conversation (“event”) platform. By accessing or using the Gather6 platform to host or participate in Gather6 events, you agree to be bound by these terms and conditions.
1.1. Gather6 Services. Gather6 allows Hosts to publish their availability for an online conversation for up to five Participants. The Hosts set the price for their time and Participants buy tickets to attend the event.
1.2. No Guarantee of Availability. Gather6 does not guarantee the uninterrupted availability or accessibility of Gather6. Gather6 may terminate or restrict the availability of all or part of Gather6 or certain features thereof without notice at any time for any reason. Gather6 may, in its sole discretion, discontinue Gather6 or any portion or feature thereof or modify the features of Gather6 from time to time without prior notice.
1.3. Your Responsibility for Bystanders. Before using Gather6, you are responsible for the privacy of any Bystanders that may be within the range of your device’s camera or microphone.
1.4. Restrictions on Content. You agree to not take screenshots or make audio or video recordings of the conversations without prior consent of all Participants in the conversation. You also agree not to post, upload, publish, submit or transmit any of this content without prior agreement from Gather6 Corp.
1.5. Gather6 use of Content. Gather6 records all conversations to ensure compliance to community guidelines. Gather6 may use segments of this conversation for marketing purposes.
1.6. User Restrictions. Gather6 may at its sole discretion permanently restrict access to the use of Gather6 at any time, with or without notice, liability, or other obligation to you.
In addition to the above General Terms and Conditions, as a Participant you agree to the following
2.1. Ticket Refunds. Gather6 tickets are non-refundable. The only exceptions to this are a) The Host cancels the event for which the Participant has purchased the ticket or b) The Host is more than 15 min late to the event.
2.2. Transfer of Tickets. Gather6 tickets are non-transferable and may only be used by the user who purchased the ticket for the specific event that it was purchased for.
2.3. Termination of Participation. Hosts have full discretion to mute or eject a Participant from the conversation without a refund. Guidelines for participating in a Gather6 event are laid out in the Gather6 Participant Prep Guide.
2.4. Late Attendance. Participants will not be allowed to attend the conversation if they attempt to join the conversation 10 minutes or greater than 10 minutes late. In such cases the ticket cost will not be refunded.
2.5 Soliciting. Participants are not allowed to sell goods or services to Hosts or fellow Participants during the conversation. Participants are also not be allowed to seek any form of employment or offer their own skills, expertise or advice in return for any form of economic compensation.
2.6 Sanctions. Participants are not allowed to abuse, slander or threaten a Host or any Participant. Participants are not allowed to express discriminatory or prejudicial statements about any ethnic, national, gender, sexual, age or religious group. Participants agree to allow Gather6 to forward the Participant’s contact details to any regulatory, civil and criminal government authority, or legal representatives, in the event that any third party, not restricted to the Host and other Participants, seeks to initiate legal action against the said Participant.
In addition to the above General Terms and Conditions, as a Host you agree to the following
3.1. Event Cancellation or late attendance. If the Host cancels an event or is late by fifteen minutes or later then the Participants are eligible for a full refund of the ticket price.
3.2 Presence: Hosts must be in video attendance at the start of their scheduled session and for the full hour of the conversation. Hosts must minimise any distractions and visual or audio noise around themselves.
3.3. Event Hosting. As a Host you are in charge of the conversation, you may mute or remove any Participant from the conversation at your discretion. Gather6 is not liable or responsible for your or any Participants’ behaviour during the event.
3.4. Service Fees. Unless otherwise agreed to in a written agreement between Gather6 and you, Gather6 charges a 16% service charge on the ticket price. This service fee includes all platform related costs including any fees charged by third party payment providers on the Gather6 platform.
3.5. Payment to Hosts. Hosts are solely responsible for setting up their own Stripe account for transfer of funds from Gather6 to the Host account for their events. Hosts will receive funds net of the service fees to their account, Gather6 cannot guarantee the timing of the transfer from the Stripe account to the Host account.
3.6. Taxes and other Withholdings. Hosts are responsible for reporting income generated from Gather6 to the relevant tax authorities. Gather6 takes no responsibility in withholding or reporting of host income.
3.7 Sanctions. Hosts are not allowed to abuse, slander or threaten a Participant. Hosts agree to allow Gather6 to forward the Host’s contact details to any regulatory, civil and criminal government authority, or legal representatives, in the event that any third party, not restricted to the Participants, seeks to initiate legal action against the Host.
You agree that you are solely responsible for your activity on Gather6. To the maximum extent permitted by applicable law, your use of Gather6 and your hosting of any event is solely at your own risk. We do not assume any liability or make any warranties of any kind, express or implied, arising out of, in connection with, or with respect to any user content or events. You acknowledge that we are under no obligation to verify the background or qualifications of any event Host or event Participant. To the maximum extent permitted by applicable law, in no event will Gather6 or its affiliates be liable for any act, error, or omission by any third-party which arises out of or is in any way connected with a user’s attendance, use of, or participation in an event. You assume full responsibility for the choices you make before, during, and after your participation in any Gather6 event. To the maximum extent permitted by applicable law, in no event will Gather6 or its affiliates be liable for any claim for illness, bodily injury, disability, damage to tangible property, emotional distress or death that arises in connection with your participation in an event.
Notwithstanding anything to the contrary in a service agreement between Gather6 and you, under no circumstances and under no legal theory (whether in contract, tort, negligence or otherwise) will Gather6, its affiliates, or their respective officers, directors, employees, agents, subcontractors, licensors, or suppliers be liable to you, a user, or any other third-parties for any indirect, incidental, special, exemplary, consequential, or punitive damages, including lost profits, lost sales or business, lost data, business interruption, or any other loss incurred by you, a user, or any other third party in connection with your use of Gather6 and your hosting of an event, regardless of whether Gather6 has been advised of the possibility of or could have foreseen such damages.
You agree to indemnity, defend and hold harmless Gather6, its affiliates, and their respective officers, directors, employees, agents, subcontractors, licensors, and suppliers against any suits, demands, or claims and associated losses, costs, expenses (including attorneys’ fees), damages and liabilities, brought by a third-party and arising from or relating to: a) Your breach of these Terms and Conditions; b) Any violation of applicable law or regulation by you; c) Your gross negligence, recklessness, or wilful misconduct; or d) Your use of Gather6 or those acting on your behalf.
